Description:
THIS IS A SPECIAL NOTICE PREPARED IN ACCORDANCE WITH FEDERAL ACQUISITION REGULATION (FAR) SUBPART 5.2 “SYNOPSES OF PROPOSED CONTRACT ACTIONS” NAICS: 334220 Estimated Delivery Period: March through April 2021 Response Deadline: 10:00 a.m. Pacific Time on December 21, 2020 The U.S. Army Corps of Engineers (USACE), Portland District (NWP) intends to negotiate/award a sole-source contract with Northwest Marine Technology, Inc. (NMT) for coded wire tags (CWT) to inject into fish as part of the NWP Hatchery Program. The Government has determined this contract to be of critical importance to the operations of NWP Hatchery Program, and that feasible substitutes are not available. REASON FOR SOLE SOURCE ACQUISITION: The statutory authority for this non-competitive acquisition is 10 U.S.C 2304(c)(1) as implemented by FAR 13.1061(b), Only One Responsible Source and No Other Services Will Satisfy requirements. The proposed sole source contractor is NMT is the only known company, to date, that manufactures CWTs for hatchery evaluation purposes. CWTs, CWT injection equipment, CWT detection equipment, and parts and repair for injection and detection equipment are manufactured and distributed solely by NMT. Each group of tags is made for a specific agency and contains a unique batch number or individual code. NMT’s detection equipment is protected by several U. S. Patent rights (4955396, 4655396, 4753193, and 5134370). Northwest Marine Technology, Inc. USACE NWP has purchased all previous contracts for CWTs were awarded as sole source to NMT. The decision for awarding without further competition was due to the patent rights held by NMT, remaining exclusive to NMT only. Competition is not available in the open market. At this time, a solicitation does not exist. All responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency. *NO PHONE INQUIRIES, PLEASE.
